Despite the recent overturn regarding the recreational use of marijuana in Oklahoma, Oklahoma still has the use of a medical marijuana program. With the new laws in place and new requirements, it is more important now than ever to understand your rights and what the program allows.

Who Makes the Rules

With the vast majority of medical marijuana programs, there is a presiding group that makes the decisions about what is going to happen regarding medical marijuana, how it is to be distributed, application processes and so much more.

For the state of Oklahoma, they have the OMMA which stands for the Oklahoma Medical Marijuana Authority.  This group acts underneath the Medical Marijuana and Patient Protection Act.  

The combination of OMMA and the patient protection act is what helps legislation make the rules that are there to protect patients, their caregivers, and even minors who require the assistance of medical marijuana.

What are the Rules

Keep in mind that at any point in time, a designated medical marijuana specializing judge has the right to overturn or change the rules.  They have to do so under the observation of OMMA, but this requires any medical marijuana user to regularly stay up-to-date with any rule changes. 

Currently, these are the major rules that can be found online as provided by the state of Oklahoma:

  • Have to be a legal resident of Oklahoma with a valid ID.
  • All applications have to have current photos.
  • Doctor has to be registered for medical marijuana and must be in good standing with the state.
  • People under 18 can apply for a card but must do so with parental and doctoral approval.
  • If you are a caregiver, you can purchase medical marijuana only if you have the proper license. 
  • If you abuse your medical marijuana, your physician can terminate your card at any point in time.

What Are My Possession Rights

As a caregiver or patient, you are allowed the following medical items within your household or on your person as long as you have the appropriate card or license:

  • A total of three ounces on your  person
  • Six mature plants and their product
  • Six seedling plants
  • A total of one ounce of concentrated marijuana
  • Up to 72 ounces of edible marijuana
  •  A total of eight ounces of marijuana bud in a residence
  • Up to 72 ounces of topical marijuana substances

Something to remember at all times is that even though the marijuana is owned by the person, no one is allowed to sell, trade, or transfer medical marijuana to another individual. 

The only people allowed to do that are those that have a medical marijuana commercial license.  This protects the patient, any other people involved in the use of marijuana as well as the prescribing physician. 

How do I Get a Card

The application process can be done online very easily.  There are physical ways to apply as well, however, other forms of applications are reserved for veterans who have 100% disability.  

There are also two different options for the card or license that you are applying for: long-term or short-term.  Generally speaking, it is up to your physician to determine whether or not you need a long/short-term card, but the application process is still the same.

Keep in mind that when you apply, you will need to have a valid address, a valid driver’s license, a recent photo (must have been taken within 6 months of the application time), and accurate contact information.  If you don’t have these pieces, then you will more than likely be denied a medical marijuana card.

You can apply for a card with the state or use companies such as Marijuana Doctors and others in order to get a card.  Each company is required to have representatives that can help you through the application process.

One last thing on licenses and cards: in the state of Oklahoma, licenses and medical marijuana cards are not reciprocal between states.  This means that they are only valid in the state of Oklahoma and cannot cross state borders.
